9th Circuit Court Strikes Down Trump’s Muslim Ban Again
The 9th Circuit Court, on Monday, again struck down Donald Trump’s Muslim-ban executive order blocking travel from six Muslim-majority countries.
The court decision is another blow to the Trump administration as it waits for the Supreme Court to decide whether to intervene.
The California-based 9th circuit court affirmed part the Hawaii district court ruling that blocked the temporary ban on nationals from six-majority countries from entering the U.S.
Trump’s Muslim-ban will remain blocked nationwide.
Importantly, the court ruling found that Trump exceeded the powers of his office.
“We conclude that the President, in issuing the Executive Order, exceeded the scope of the authority delegated to him by Congress.”
“Immigration, even for the President, is not a one-person show,” the court continued.
The ruling also cited Trump’s recent tweets in its case against his ban.
“Indeed, the President recently confirmed his assessment that it is the ‘countries’ that are inherently dangerous, rather than the 180 million individual nationals of those countries who are barred from entry under the President’s ‘travel ban,’” the court wrote.
The court cited one of Trump’s tweets from June 5, 2017: “That’s right, we need a TRAVEL BAN for certain DANGEROUS countries, not some politically correct term that won’t help us protect our people!” the quoted tweet read.
The court also included a link to a May statement by the White House that confirmed that all of Trump’s tweets are “considered official statements by the President of the United States.”
