Democrats Considering Lawsuit Against Trump For Violation Of Constitution’s Emoluments Clause

Senate Democrats are seriously considering filing a lawsuit against Donald Trump alleging that by failing to disconnect himself from his businesses Donald Trump has violated the Constitution’s Emolument’s Clause.

According to The Hill, the lawsuit effort is being led by Senator Richard Blumenthal of Connecticut.

Senator Feinstein confirmed that Senator Blumenthal “is leading an effort, asking each one of us to contribute an amount of money for a court case.”

“We’re looking at that,” Feinstein said. “The hope is that there will be 41 of us that will be on that court case.”

The report by The Hill noted that other Senators have also heard from Blumenthal on the lawsuit idea. Senator Durbin confirmed he had heard from Blumenthal and said, “I would want to sit down and talk to him about it. It’s something I’m very interested in looking at.”

The Constitution’s Emoluments Clause says that “no person holding any office of profit or trust under them, shall, without the consent of the Congress, accept of any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state.”

Based on even a layman’s reading, it would seem that just by the mear fact that Trump is renting hotel space and selling condos around the world to foreign governments and their proxies that he is in violation.
